Booking Terms & Conditions
Please read through the following terms & conditions carefully.
It is the responsibility of the person making the booking (the party leader)
to ensure that every member of the party has read and fully understood all
the booking conditions.
The booking conditions as below apply to all booking
made through Holidays in Newquay (incorporating Diamond Holidays Rentals).
Your Contract
(1a) Our acceptance of your deposit or full payment forms a contract
between Holidays In Newquay and the party leader acting on behalf of all
person in the party. You are deemed to accept these booking
conditions. We reserve the right to change our terms & conditions
without notice.
(1b) When making a booking you are required to submit an online
booking form with all details of yourself and the names of all party members
along with ages. You are also accepting the booking condition on behalf of
all persons in the party. You will also be responsible for the payment of
the holiday booked.
(1c) When you are making a booking for under 18years
you as the booking person must ensure all party members have fully
understood the booking terms & conditions and also accept you are liable for
the party actions on staying at the accommodation. You will also be
responsible for the payment of the holiday booked.
(1d) We will send all correspondence to you via email
or text
and it is your responsibility to keep all party members informed. We
can not discuss the booking or enter into communications with any other
member of the booking or 3rd party.
(1e) In the booking terms & conditions, 'the company',
'we', and 'us' refer to Holidays In Newquay and 'you' refers to the party
leader.
(1f) The rental agreement is made on the basis that
the accommodation is to be occupied by the Tenant (you) for a holiday as
mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the Tenant
acknowledges that tenancy granted by this agreement is not an assured
tenancy and that no statutory periodic tenancy will arise when it ends.
(1g) Holidays in Newquay accept no responsibility for
personal injury to guests, loss or damage to their property, or other
matters that we have no control.
(1h) We can not be held responsibility for loss of any
services (gas, water, electric & heating etc) through out your stay.
Bookings
(2a) At the time of the booking you are required to
submit and booking form either online or over the phone, (all booking done
over the phone will require a booking form sent to you in the post.
You will need to check the form, sign and return). You are also
required to pay a deposit or payment in full. A minimum deposit of 25%
is required with all bookings.
(2b) Once your deposit has been received your will be
email your confirmation details , once your have received
the email YOU must check this & notify us of any incorrect information as
this may invalidate your booking. It is your responsibility to check
all the details on the confirmation letter are correct. The confirmation
letter will
tell you by what date your balance & bond is due.
(2c) Provisional booking will only be held for 5 days for us to receive the
deposit.
(2d) The holiday balance & compulsory security bond
must reach us by your due date. (your due date can be found
on your confirmation letter).
(2e) All booking made less than 6 weeks before
arrival must be paid for in full when booking. And can only be paid for by
debit/credit card.
(2f) All deposit are non-refundable and
non-transferable. We recommend that personal holiday insurance is
taken out to cover any cancellations.
Deposit will be refunded is we are unable to accept the booking for any
reason.
(2g) On receipt of your initial payment we will email
or text
your login in details. This will note the details of your booking
and also act as a invoice for any outstanding monies. If any details
are incorrect you must advice us within 7 days. We cannot accept
responsibility for any errors concerning your booking after this time.
(2h) If the balance and bond is not paid by the
due date which will be confirmed on your confirmation letter, the booking will be terminated with loss of any monies paid.
However if we are unable to re-book the accommodation you will remain liable
for the outstanding accommodation costs.
(2i) Any monies which are not honoured by your bank / card company may
result in your holiday being cancelled.
(2j) Late payments or changes to bookings will result in a administration
change.
(2k) We do not accept any bookings from parties under 16 years
of age.
All bookings for parties under 18 years of age must be made by a parent or legal guardian.
(2l) For group bookings under the age of 18 must
provide their dates of birth to ensure all party members are 16years old or
more.
(2m) Whilst we endeavour to accommodate any special
requests, we can not issue any guarantees.
Curfews:-
There are no curfews set for our accommodations unless we see fit to enforce
any.
Payments
(3a) All bookings more than 6 weeks before arrival can
be paid for by the following methods:
Cheque, Postal Orders, Debit or Credit Card.
(3b) All bookings less than 6 weeks before arrival can
be paid for by the following methods:
Debit or Credit Card.
(3c) We will only accept one cheque or credit/debit
card transaction per booking payment.
If you wish to make individual
payments then the following charges will apply.
Cheques - 50p each
Debit Cards - 50p each
Credit Card - 2.5% charge
(3d) All cheques or postal orders are made Payable to
Mr O'Dell and sent to: Booking Office 2 Playingfield Lane, Mount Wise,
Newquay Cornwall TR7 2DB.
Security Bond
(4a) All booking require a compulsory security bond.
(4b) All security bonds are to be paid along with the
balance, (by due date).
(4c) All security bonds will be refunded within 14days
of your holiday finishes. And will be refunded by the same method they
are paid.
If you paid by card we will only refund it to the card number that it was
paid by.
(4d) Whilst staying at any of Holidays In Newquay
properties we kindly ask that you respect your fellow guest, accommodation
staff, accommodation property, and all 3rd party. Naturally, we want
you to enjoy your holidays, but this can not be at the expense of anyone
else. Should we deem it necessary to ask a guest to leave the
accommodation, then the remainder of his/her party will also be asked to
leave, and they will forgo all security bond and accommodation charges that
have been paid.
(4e) In the event of malicious, wilful, or negligent
to the accommodation or other property damage over the security bond amount we
will charge you for all applicable amount of loss sustained by holidays In Newquay.
Whilst Staying At Any One of Holidays In Newquay
Properties
(5a) Check in time is 4pm to 6pm. Unfortunately,
we can not guarantee that any accommodation will be available before this
time so we recommend that you make you travel arrangements accordingly.
If you are travelling by public transport please contact the office before
booking regarding a later arrival.
(5ai) Anyone who wishes to arrival after 9pm will be
subject to a charge.
(5b) Check out time is by 09.30am. We kindly ask
you to vacate your accommodation by this time or you will incur a charge.
(5c) Should you decide to leave our accommodation
before your departure date for any reason, no refund will be available for
the remaining stay.
(5d) We do not accept anyone under the age of 16years
old. Should anyone arrival and appear to be under this age we will ask
for proof of age.
(5e) Only those named on the booking form may enter
our accommodation and grounds. Due to fire regulations you are not
permitted to have visitor to the accommodation or grounds.
(5f) The party leader or booking person (legal
guardian or parent) will be held responsible for any damage to the
accommodation or grounds. All breakages must be reported and paid for
within 24hrs. Failure to do so will result in the damage charges being
deducted from the security bond.
(5g) Parking in our car park. We have a
independent wheel clamping firm operating within our grounds, any vehicle
not displaying our permit or parked within the white line or in the correct
bay will be clamped. Please do not leave you vehicle in our car park
until you have checked in and been issued with your parking permit.
(5h) All our accommodation are non-smoking in the
bedrooms.
(5i) The property owner or his representative or a
member of Holidays In Newquay Staff have the right to enter the
accommodation at any time, whether the accommodation is occupied or not.
(5j) We supply your bedding, tea towels, bath
mats. Your beds are made up for your arrival. We supply
heating in the winter months (End September to Beginning April).
Is there anyway my booking can be terminated?
(6a) We reserve the right to terminate without notice
your booking of any customer whose behaviour is such that it is likely, in
our reasonable opinion, to cause distress, damage, or annoyance to other
customers, employee, 3rd party, or to the accommodation property or grounds.
(6b) Attempt to entertain any visitors.
(6bi) Allow other guest from other accommodations into your accommodation
and you going into their accommodation, whether they are staying at Eton Court
Accommodation or not.
(6c) To have anyone not named on the booking form in
the accommodation or grounds.
(6e) To attempt to overload the accommodation with
more people than it can legally hold.
(6f) Under take any activity which may cause
unreasonable damage, noise or disturbance to others.
(6g) To bring Illegal substance in to the
accommodation and to smoke within the accommodation.
(6h) If you fail to pay your balance and bond by the
due date.
(6i) We reserve the right to refuse any booking on
arrival if we feel fit to do so, or if the names on the booking form does
not match these who attempt to occupy the accommodation on arrival. (all
name changes must be informed to the office at least 48hrs before arrival.)
Damage, Breakages, Cleanliness & Mics;
(7a) You shall keep the accommodation and all,
fixture, fittings and effects in or on the holiday accommodation in the same
state of repair & cleanliness as at the commencement of the holiday and not to move any of
the furniture, e.g beds, tables etc.
(7b) We do not allow any one to sleep on the sofa's,
and ask that all bedding (duvet, pillows) including the mattress protectors
stay on the beds.
(7c) The accommodation shall be left in the same
state of cleanliness its was presented to you in. Any excess cleaning
will be charge for. Minimum charge £50.00.
(7d) Any lost keys are charged at £50.00 and must be
reported and paid for immediately. All our keys are security keys.
(7e) Any excessive usage on gas, water & electric and
extra heating will be charge for.
(7f) Extra Parking spaces may be available at a
charge, but until arrival day we can not guarantee any extra spaces.
Pets ( animals )
(8) Sorry we do not accept dogs or any other pet in
our accommodations.
If you Change or Cancel your booking
(9a) Any major changes or amendments to all bookings (i.e
change of dates, names) after the initial confirmation has been issued will
be subject to a charge. All notification of changes to your booking
must come from the party leader or booking person, by either email or
writing.
(9b) We must be notified of any change of address or
phone numbers including your mobile phone given on booking form at your earliest convenience.
(9c) All deposit are non-refundable and
non-transferable. We recommend that personal holiday insurance is
taken out to cover any cancellations.
Deposit will be refunded if we are unable to accept the booking for any
reason.
(9d) In certain circumstance you may be able to get a
refund. e.g unexpected posting or cancellation of leave by HM Forces.
A substantiating certificate will have to be produced in all cases. We
will not issue a full refund for any other reason.
(9e) All cancellations must be done in writing by the
booking person or party leader. In event that you are not covered by
insurance , we will endeavour to re-let the accommodation, if we are
successful the balance of the accommodation will not be due, or if already
paid will be refunded, less the deposit.
Accommodation becoming unavailable
In the event of the accommodation becoming unavailable
(e.g through fire or illness), we will endeavour to provide suitable
alternative accommodation or will refund all monies paid or a proportion in
the case of curtailment. We reserve the right to move you to a
alternative accommodation if necessary within Eton Court.
Complaints
In the event of there being cause for compliant
concerning a property, the matter should be taken up with the
owner/caretaker or holidays in Newquay staff at once. It is important
that this is done whilst you are still at the property so that
an-on-the-spot investigation can be made if necessary and remedial action
taken if required. In no circumstance will compensation be made for
complaints raised after the tenancy has ended when the tenant has denied the
owner/caretaker/staff the opportunity of investigating the complaint and
endeavouring to put the matter right during the tenancy. All
complaints
must be done by the party leader or booking person.
Date Protection
We will retain your personal information which you
provide on your enquire or booking form. This information will not be
passed on to any 3rd parties, other than when required by law. |
